1. It is alleged that Douglas Alger failed to withdraw as the solicitor for the executors of the estate of KM after it became clear that he was to be a witness regarding the events surrounding the execution and validity of KM’s 2018 will and that such conduct is deserving of sanction.
2. It is alleged that Douglas Alger acted in a conflict of interest by taking steps that were contrary to the interests of the beneficiary of KM’s 2018 Will, to whom he owed a duty of care as the drafter of KM’s 2018 will and that such conduct is deserving of sanction.
3. It is alleged that Douglas Alger acted in a conflict of interest by accepting instructions from the executors of KM’s estate, who were acting in a conflict of interest as the executors of KM’s 2018 Will while simultaneously seeking to become the beneficiaries of that will pursuant to a false intestacy, and that such conduct is deserving of sanction.
4. It is alleged that Douglas Alger prepared and witnessed a document that he knew contained false and misleading statements denying the existence of any will by KM, and that such conduct is deserving of sanction.
5. It is alleged that Douglas Alger knowingly submitted false and misleading information to the Court of King’s Bench to obtain a Grant of Administration when he knew about the existence of previous wills by KM and that such conduct is deserving of sanction.
6. It is alleged that Douglas Alger relied upon a falsely procured Grant of Administration in gathering the assets of KM’s estate for the benefit of the executors and that such conduct is deserving of sanction.
