Notice of Suspension - Darrell Elgert
On November 29, 2010, a Hearing Committee found the conduct of Darrell Elgert, who practises in Edmonton, Alberta, to be deserving of sanction on 18 citations.
The matters in which his conduct was found to be deserving of sanction included: failing to recommend his client obtain independent legal advice in respect of personal loan transactions with him, breaching and/or failing to fulfill undertakings within a reasonable time, failing to report breaches of undertakings to opposing counsel, failing to respond to clients and opposing counsel, failing to serve his clients, failing to forward his file to successor counsel in a timely fashion, acting while in conflicts of interest, failing to cooperate with the Law Society, and failing to respond to the Law Society on a timely basis and in a complete manner in four separate complaints.
The Hearing Committee ordered, pursuant to Section 72(1)(b) of the Legal Profession Act R.S.A. 2000, c. L-8, that Mr. Elgert be suspended for 6 months, effective December 17, 2010.
The Hearing Committee also ordered Mr. Elgert to pay the actual costs of the hearing estimated in the amount of $9,124.50.
Mr. Elgert practised with partners who have assumed responsibility for his files.
