Notice of Disbarment - Manish Bindal
On September 15, 2010, a Resignation Committee of the Benchers of the Law Society of Alberta approved the application of Manish Bindal to resign, pursuant to section 61 of the Legal Profession Act, R.S.A. 2000, c. L-8. Mr. Bindal is therefore disbarred. Mr. Bindal was a suspended member of the Law Society at the time of his resignation. He resides in Calgary, Alberta and practised from October 27, 1995 to February 15, 2005 when he elected to become inactive. On March 31, 2006 Mr. Bindal was suspended due to non-payment of his fees.
Mr. Bindal faced a discipline hearing on eight (8) citations at the time of his resignation application. The citations alleged that, inter alia, Mr. Bindal had a trust shortage of over $700,000 which he failed to report to the Law Society and that he failed to be candid with his accountant and the Law Society to disguise the trust shortage until he fully repaid it over one year later. Mr. Bindal admitted facts and the foregoing allegations.
The Resignation Committee directed that Mr. Bindal pay the actual costs of the discipline proceedings and the resignation application, estimated at $2,026.50. The Resignation Committee further directed, in accordance with Section 78(6) of the Legal Profession Act, that the Executive Director send a copy of the hearing record to the Minister of Justice and Attorney General.
