Notice of Suspension - Mary Jo Rothecker
On February 18, 2010, a Hearing Committee found the conduct of Ms. Mary Jo Rothecker, a suspended member of the Law Society who formerly practised in Cochrane, Alberta, to be deserving of sanction on five citations. A disposition hearing was held on June 24, 2010.
The citations on which her conduct was found to be deserving of sanction were as follows: failing to respond on a timely basis and in a complete and appropriate manner to communications from the Audit, Practice Review and Conduct Departments of the Law Society that contemplated a reply, failing to follow the provisions of the Rules of Court or of her own written fee agreement with her client when calculating her fees, and failing to charge her client a fair and reasonable fee.
The Hearing Committee ordered, pursuant to section 72(1)(b) of the Legal Profession Act, R.S.A. 2000, c. L-8, that the membership of the member shall be suspended for 15 months commencing on June 24, 2010. The Hearing Committee also ordered that the member shall pay the actual costs, estimated to be $16,000.00, within 15 months.
